On January 16, 2025, Chambers and Partners, the internationally renowned legal ranking institute released the Chambers Greater China Region Guide 2025. GEN Law was privileged to write the year-end review of China Intellectual Property Litigation which was featured in the guide. He Jing, Jerry Xia, Steve(Kefeng)Zhao, Dong Ning, and Lu Liang contributed to the review.
The article analyzed the development of China's judicial protection of intellectual property rights in 2024. Reflecting on the past year, the number of intellectual property cases in China maintained its upward trajectory, with courts awarding record-breaking damages in several high-profile cases. Cases involving AI began to attract judicial attention, and courts at various levels demonstrated an increasingly positive stance towards protecting intellectual property rights for AI-generated works. In the realm of standard-essential patents, courts delivered significant rulings on several cases, while antitrust authorities issued new SEP guidelines. It is observed that foreign companies' engagement in intellectual property litigation in Chinese courts continued to rise.
